Is Medical Marijuana Legalized in Kentucky?

Governor Beshear issued an executive order titled “Executive Action Relating to Medical Cannabis,” which went into effect January 1st, 2023. This executive order outlines the framework for Kentucky’s medical marijuana program. It provides a pathway for Kentuckians to use medical marijuana without fear of being a criminal. With your Kentucky medical marijuana certificate, you will be allowed to possess up to eight ounces of marijuana so long as it was purchased lawfully. If you were charged with possession in Kentucky, Governor Beshear would extend a full pardon.

Governor Beshear’s executive order does NOT allow for the sale of medical marijuana within the state; qualifying medical marijuana patients must purchase their medication at a licensed dispensary. Many of our patients purchase from weed stores in Missouri, Illinois, and Michigan. If a patient is under the age of 21, they will need to designate a caregiver to make purchases on their behalf. If the patient is a minor (under 18 years old) our office will not certify them at this time.

In 2025, Senate Bill 47 will take effect. SB 47 will continue to allow patients with certain qualifying medical conditions to obtain a doctor’s recommendation to use cannabis medicinally. With this recommendation, patients will be able to apply for a Kentucky medical marijuana card. The bill will not allow patients to smoke marijuana, although it will allow for the sale of unprocessed cannabis flower for vaporization. Marijuana will be available in other forms, including capsules, tinctures and topical products. An important difference between SB 47 and Governor Beshear’s executive order is that SB 47 will allow for the sale of medical marijuana within the state of Kentucky. Currently, there is no limit on how many medical marijuana dispensaries may open in Kentucky, but that could change when specific regulations are released.

You do not need a Kentucky medical marijuana card to use CBD, but you do need a Kentucky medical marijuana card to use cannabis/marijuana.
